Terms of Service

These Terms of Service (“Terms”) govern your use of Fleqra (the “Service”), operated by Product Guru IT Ltd (“we”, “us”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Account & eligibility

  • You must be at least 18 years old or the age of majority in your jurisdiction
  • You must provide accurate registration information
  • You are responsible for keeping your password secure
  • You are responsible for all activity under your account

2. Subscriptions & billing

  • Fleqra is offered on a subscription basis (monthly or yearly). Pricing is shown at fleqra.com/pricing.
  • A 14-day free trial is included with each new subscription. You can cancel before the trial ends to avoid being charged.
  • Subscriptions auto-renew unless cancelled. You can cancel any time via the customer portal.
  • Refunds: We offer pro-rated refunds within 14 days of paid charges if you're unsatisfied. Contact billing@fleqra.com.
  • Payment is processed by Stripe. Fleqra does not store full credit card numbers.

3. Acceptable use

You agree NOT to use Fleqra to:

  • Send spam, unsolicited emails, or violate CAN-SPAM, PECR, or GDPR
  • Send phishing emails or impersonate others
  • Distribute malware or attempt to harm our infrastructure
  • Harvest emails, scrape data, or violate our rate limits
  • Generate content that is illegal, defamatory, hateful, or violates third-party rights
  • Violate any applicable laws or regulations
  • Reverse engineer, decompile, or copy the Service

We reserve the right to suspend or terminate accounts that violate these rules.

4. Content & ownership

  • Your content stays yours. You retain all rights to contacts, posts, emails, knowledge bases, and other content you upload or create.
  • You grant Fleqra a worldwide, non-exclusive license to process your content solely to provide the Service (e.g., sending emails on your behalf, generating AI responses).
  • AI-generated content: Content generated by Fleqra AI (via Anthropic Claude) becomes your property when generated, but you are responsible for reviewing it before using it publicly.
  • Fleqra retains all rights to the platform itself (software, design, trademarks).

5. AI services

Fleqra uses third-party AI models (Anthropic Claude) to power content generation, lead extraction, and the AI Sales Agent. By using these features:

  • You acknowledge that content you submit is sent to Anthropic for processing per their privacy policy
  • AI output may occasionally be inaccurate. You are responsible for reviewing AI-generated content before publishing or sending.
  • Fleqra is not liable for any harm caused by AI-generated content you choose to use.

6. Third-party integrations

When you connect third-party platforms (Facebook, Instagram, X, LinkedIn, TikTok, YouTube, Stripe, etc.), you authorize Fleqra to access data and perform actions on your behalf within those platforms. Each platform's own terms apply.

7. Service availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service.
  • We may schedule maintenance windows with reasonable notice.
  • We are not liable for downtime caused by third-party providers (AWS outages, Anthropic API issues, social platform downtime, etc.).

8. Termination

  • You can cancel anytime via the customer portal.
  • We may terminate accounts that violate these Terms, with reasonable notice when possible.
  • Upon termination, you have 90 days to export your data before it is deleted.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEQRA'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Governing law

These Terms are governed by the laws of England and Wales. Disputes shall be resolved in the courts of England.

12. Changes

We may update these Terms. Material changes will be communicated via email at least 30 days before they take effect. Continued use after changes constitutes acceptance.
